Terms of service

Please read these Terms of Service carefully before buying from our webshop or using any part of the Sooma system or associated services. These Terms do not limit your statutory consumer rights under Finnish or EU law. Where anything here conflicts with those rights, your statutory rights apply.

1. Introduction

Sooma Oy (“Sooma Medical”, “we”, “our”, or “us”) offers a non-invasive medical device that delivers transcranial electrical stimulation (tES) for the treatment of certain clinical conditions (the “Sooma System”). This includes a stimulation device (the “Sooma tDCS Device”), accessories, and may include software applications, digital content, user support, and access to associated platforms and websites (collectively, the “Service”).

These Terms cover purchases you make directly from our official webshop at shop.soomamedical.com (the “Webshop”) and your use of the Service. If you obtained your product through a clinic, distributor, or another retailer, their terms apply to your purchase, and you should contact them about it.

Your purchase and your use of the Service mean that you accept these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you are not authorized to use the Service.

2. Who can use the Service

To buy from the Webshop and use the Sooma Service, you must:

  • Be at least 18 years of age,
  • Reside in a region where Sooma Medical sells or supports its products,
  • Have the legal capacity to give informed consent.

By using the Service, you confirm that you meet these criteria and that the information you give us is truthful and complete. You must not let anyone under 18 use the device.

You do not need a prescription to buy or use the Sooma Device in the European Union. If a healthcare provider is guiding your treatment, follow their advice.

3. Using the device safely

The Sooma tDCS Device is intended for home use in line with the User Manual. It is not a substitute for professional medical advice. Always follow the instructions in the User Manual.

Do not use the Sooma System if you have:

  • Devices or metal objects on or inside the skull,
  • Acute eczema or broken skin in the stimulation area.

If your symptoms worsen, or if you have a medical emergency, stop using the device and get medical help.

4. Acceptable use

You agree not to:

  • Use the Service for unlawful, unauthorized, or harmful purposes,
  • Modify, damage, tamper with, reverse engineer, or try to gain unauthorized access to any part of the device or software,
  • Reproduce, distribute, resell, or commercially exploit the Service or any information within it without our written permission,
  • Use the system in any way contrary to the official instructions for use.

We may suspend or end your access to the software and app if your use breaks these Terms.

5. Orders

When you place an order, you are making an offer to buy. Your order is accepted when we confirm it, and a contract is formed at that point. We may decline or cancel an order, for example if an item is out of stock, if we cannot take payment, or if there was a clear pricing or description error. If we decline or cancel your order, we will contact you and refund any payment already taken.

Prices and product details can change, and the Webshop may contain occasional errors. If we find an error in the price or description of something you ordered, we will contact you before we ship it and let you choose to continue at the correct details or cancel for a full refund.

6. Prices and payment

Prices shown in the Webshop include VAT. Delivery costs, where they apply, are shown before you complete your order.

Payments are processed securely through our payment provider. You agree to give current, complete, and accurate payment and account information, and to keep it up to date.

Ownership of the device passes to you once we have received payment in full. For subscriptions, this is when your final scheduled payment is complete.

Except for the refund rights in sections 8 and 9, and your statutory rights, payments are due as agreed at checkout. If a payment fails, we may pause access to the app and contact you to arrange payment. Interest on late payments is charged in line with the Finnish Interest Act.

7. Subscription (paying monthly)

You can buy the Sooma Device with a single payment, or on a subscription where you pay in monthly installments. If you choose the subscription:

  • You pay a fixed amount each month for the number of months shown at checkout.
  • Your subscription includes the full Sooma kit and app access shown on the product page, along with a supply of conductive pads for the chosen therapy duration. Additional pads and other accessories can be bought separately.
  • Your device is shipped once, at the start. You do not receive a new device each month. The monthly payments cover the cost of your device over time.
  • Your first payment is taken at checkout. Each later payment is taken automatically on its due date, using the payment method you provided.
  • You can end the subscription and return the device under your withdrawal right (section 8) or the 30-day guarantee (section 9), and we will refund you as described there.
  • After the 30-day guarantee period, your subscription continues until all monthly payments are complete.

8. Your 14-day right of withdrawal

As a consumer in the EU, you may withdraw from your purchase within 14 days of receiving the device, without giving any reason.

To withdraw, send us a clear notice before the 14 days end. You can do this through your Sooma account at account.soomamedical.com, or by emailing returns@soomamedical.com. It is enough to send your notice before the period ends.

After you notify us, send the device back within 14 days. Return shipping is free using the label we provide. You are responsible only for any reduction in the device’s value caused by handling it beyond what is needed to check that it works and normal use.

We will refund all payments received from you, including standard delivery costs, no later than 14 days after we receive the device back, or after you show us that you have sent it, whichever is earlier. We refund using the same payment method you used, unless we mutually agree otherwise. If you are on a subscription, withdrawing also ends it and stops any further payments.

9. 30-day guarantee, returns, and refunds

On top of your statutory withdrawal right, you can return your kit within 30 days of receiving the kit for a full refund, for any reason.

To make a return, start it through your Sooma account at account.soomamedical.com, or email returns@soomamedical.com with the email address used for the order and your reason for return. Once we approve your request, we will send you a prepaid return label. Return shipping is free.

Please return the device complete, with all accessories, undamaged, and in suitable packaging. For hygiene reasons, you do not need to return used consumables such as conductive pads, and you can dispose of them. When it arrives, we will check its condition and completeness. If the return is approved, we will refund your original payment method. For a return under this 30-day guarantee, we aim to refund within 14 days of receiving the device. Where your statutory withdrawal right applies, the timing in section 8 governs.

If you return the device, any remaining subscription payments stop. After your refund is complete, app access linked to the returned device is disabled.

10. Shipping and risk

We ship from within the European Union. Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control.

Risk of loss or damage passes to you when you, or someone you name to receive it, take physical possession of the device. If a parcel is lost or damaged in transit before then, that is our responsibility.

11. Warranty

Sooma Medical warrants products against manufacturing defects for 24 months from delivery. The warranty excludes damages due to misuse, accidents, or negligence. Liability is limited to repair or replacement and excludes loss of data.

Report claims within 14 days of defect detection.

12. Your account and security

Some parts of the Service may require registration or user authentication. You are responsible for safeguarding your login credentials and all activity associated with your account. Notify Sooma immediately at support@soomamedical.com if you suspect unauthorized access or a security breach.

13. Privacy

Personal data collected through your use of the Service, including technical data, treatment logs, and feedback, will be handled in compliance with applicable regulations and our Privacy Policy. You are responsible for the accuracy, quality, legality and appropriateness of your data.

14. Intellectual property

All Sooma System intellectual property remains the exclusive property of Sooma Medical or its licensors. You are expressly restricted from publishing, selling, or otherwise commercializing any Sooma intellectual property. Please contact us should you wish to use any Sooma intellectual property such as images or logos. No rights are transferred without explicit written agreement.

15. Service availability and liability

Sooma Medical makes reasonable efforts to maintain accurate and secure services, but we do not guarantee uninterrupted availability or error-free operation. Except where prohibited by law, we disclaim all warranties related to the Service.

In no event shall Sooma Medical be liable for indirect, incidental, or consequential damages, including any loss of data or health outcomes resulting from improper or unauthorized use of the system.

16. Changes to these Terms

We may update these Terms from time to time. Updates will be posted with a revised effective date. Your continued use of the Service following such changes constitutes your acceptance of the revised Terms.

17. Ending access

We reserve the right to suspend or permanently disable access to the Service, without prior notice, if we believe that a user has violated these Terms, applicable laws, or poses a risk to the integrity of the system or its users.

18. Governing law and disputes

These Terms are governed by the laws of Finland. As a consumer, you also keep the protection of the mandatory rules of the country where you live.

If you have a complaint, please contact us first at support@soomamedical.com so we can try to resolve it. If we cannot resolve it together, you can refer the matter to the Finnish Consumer Disputes Board, and you can get advice from the Consumer Advisory Service. You can also bring a claim before the competent courts, including the courts of the country where you live.

19. If part of these Terms cannot be enforced

If any part of these Terms is found to be unlawful or unenforceable, the rest stays in force. The unenforceable part will apply as far as the law allows, or be treated as removed if it cannot.
